Terms of Use
Agreement and parties
These Terms of Use ("Terms") are an agreement between you and Olawale Filani ("we", "us"), United Kingdom, about the CleanSpace app for iPhone ("CleanSpace" or "the app"). By downloading or using CleanSpace you accept these Terms. If you do not accept them, do not use the app.
Apple Inc. ("Apple") is not a party to these Terms and is not responsible for the app or its content. Apple is a third-party beneficiary of these Terms and may enforce them against you.
Licence
We grant you a personal, non-transferable, non-exclusive, revocable licence to use CleanSpace on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The app is licensed, not sold.
What the app does, and your responsibility
CleanSpace looks through your photo library and, if you choose, folders and drives you pick, and suggests items that may be worth removing: exact copies, similar photos, big videos and photos, screenshots, screen recordings, duplicate and large files.
You choose and confirm every removal. CleanSpace never deletes anything on its own.
- Photos and videos you remove are moved to the Photos app's Recently Deleted album, where iOS keeps them for up to 30 days before deleting them permanently. You can recover them from there within that time.
- Files removed from folders, iCloud Drive or external drives may be deleted immediately and may not be recoverable.
- Similarity detection and "suggested keeper" recommendations are best-effort. Two photos the app calls similar may not be, and the photo it suggests keeping may not be the one you would pick. Review before you confirm.
- You are responsible for keeping backups of your photos and files.
Free tier and CleanSpace Pro
The free version of CleanSpace lets you look through your library, review every category, compare groups side by side and see what could go. Removing the items you chose, in the photo library and in folders or drives, requires CleanSpace Pro.
Subscriptions and purchases
CleanSpace Pro is available as:
- Monthly: $4.99 per month. Payment is charged to your Apple Account at confirmation of purchase. The subscription renews automatically at the same price each month unless it is cancelled at least 24 hours before the end of the current period. You can manage or cancel it in Settings › Apple Account › Subscriptions on your iPhone.
- Yearly: $14.99 per year, with a 3-day free trial. Payment is charged at the end of the trial unless you cancel at least 24 hours before it ends. The subscription renews automatically at the same price each year unless it is cancelled at least 24 hours before the end of the current period.
Switching between the monthly and yearly plans is handled by Apple, which credits any unused portion of the current period against the new one.
Prices are shown in United States dollars here. The App Store shows the price in your local currency, which may differ, and the App Store price is the one that applies.
All payments are processed by Apple. Refunds are handled by Apple under the App Store's terms; request one at reportaproblem.apple.com. You can restore an earlier purchase on any device signed in with the same Apple Account using Restore Purchases in the app.
Acceptable use
You may not copy, modify, distribute, sell, rent or lease the app; reverse engineer, decompile or attempt to extract its source code, except where the law expressly allows; use it to break the law or anyone's rights; or use it in a way that breaches Apple's terms.
Intellectual property
CleanSpace, its name, icon, design and code belong to Olawale Filani and are protected by copyright and other laws. Your photos and files remain yours. We claim no rights to them and never see them.
Disclaimer of warranty and limitation of liability
CleanSpace is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, to the fullest extent permitted by law. In particular, we do not warrant that every duplicate or similar photo will be found, or that everything the app groups together is in fact a duplicate.
To the fullest extent permitted by law, we are not liable for any loss of photos, videos or files that you chose and confirmed for removal, for any indirect, incidental or consequential loss, or for any loss of data that could have been avoided by keeping a backup. Where liability cannot be excluded, our total liability to you is limited to the amount you paid for CleanSpace Pro in the twelve months before the claim.
Nothing in these Terms limits or excludes rights you have as a consumer under the law of your country, which apply regardless of these Terms.
Apple-required terms
- Maintenance and support. We alone are responsible for maintaining and supporting CleanSpace. Apple has no obligation to provide any maintenance or support for the app.
- Warranty. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price to you. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
- Claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to the app, including product-liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims under consumer-protection or similar law.
- Intellectual property claims. If a third party claims that the app infringes its intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
- Legal compliance. You represent that you are not located in a country subject to a United States government embargo or designated as a "terrorist supporting" country, and that you are not on any United States government list of prohibited or restricted parties.
- Third-party terms. You must comply with any applicable third-party terms when using the app.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and, on your acceptance, may enforce them against you.
Termination
You can end this agreement at any time by deleting the app. We may end it if you breach these Terms. When it ends, the licence ends and you must stop using the app. Sections on intellectual property, disclaimers, limitation of liability and governing law survive.
Governing law and disputes
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules. Disputes are subject to the courts of England and Wales, except that consumers may also rely on the mandatory laws and courts of the country in which they live.
Changes to these terms
We may update these Terms. The current version is always at clearspacemobile.com/terms, with the effective date at the top. Material changes are noted in the app's App Store release notes. Continuing to use the app after a change means you accept the new Terms.
